The Plain Dealer from Cleveland, Ohio (2024)

The Plain Dealer cleveland.com Saturday, April 28, 2018 Corruption Informant Kelley free after doing his time ERIC HEISIG Kelley, 48, confirmed in an email that he was released Friday from a halfway house, finishing a sentence handed down to him in 2013. The former Cleveland-area resident, who now lives in suburban Tampa, asked for privacy for him and his family and declined further comment. Kelley will be on probation for three years. An employee in the county engineer's office, Kelley was the first defendant to go to the FBI and offer help after agents fanned out throughout the county and searched government offices, businesses and the homes of suspects on the morning of July 28, 2008. Within hours, Kelley approached agents and said he would provide information about his friends in County Commissioner Jimmy Dimora's inner circle, dubbed the A-Team.

He confessed to being a middleman for bribes and a witness to lavish trips, parties with prostitutes and the finest dining paid for by contractors seeking county business. This included passing bribe money from attorney Anthony O. Calabrese III to Dimora to have the county purchase the downtown Ameritrust complex as a site for new county offices. The purchase and the problems surrounding it cost the county more than $4.5 million. Kelley also testified in the trial of Dimora and his driver, Michael Gabor, and helped secure convictions against both men.

He also provided information that helped prosecutors obtain guilty pleas from Calabrese, County Auditor Frank Russo and others. At his sentencing in December 2013, U.S. District Judge Sara Lioi criticized Kelley's criminal acts but credited him with exposing three dozen schemes that investigators didn't know about. She sentenced him to six years in federal prison, much less than he could have faced had he not cooperated. Kelley receives nearly $5,900 a month in disability payments after taxes from the Ohio Public Employees Retirement System.

He started receiving the payments not long after pleading guilty to conspiracy, bribery and tax charges. While privacy laws prohibit the state from releasing why a person is on disability, he told a federal judge when he pleaded guilty in 2009 he was under a doctor's care for depression and insomnia. The U.S. Attorney's Office is seeking to garnish a quarter of his monthly disability earnings to put toward the $655,045 in restitution he owes. Assistant U.S.

Attorney Alex Rokakis wrote in a court filing in October that Kelley had put no money toward his restitution since he was sentenced. Kelley has challenged the government's attempts to garnish his disability. Lioi has not ruled on whether to approve the garnishment. The federal government's corruption probe into Cuyahoga County led to convictions against more than 60 politicians, government employees and private contractors. Voters approved a new form of county government in 2009.

J. Kevin Kelley, a former Cuyahoga County employee and Parma school board mem- Kelley ber who emerged as one of the main players and a key informant to federal authorities in the sprawling local corruption probe, is a free man.
